See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 16, 2022, Attorney Baronoff requested the following records: [1] All records related to [identified] SPO ballistics analysis and testimony in the [identified] case of ... including those pertaining to the Cobra weapon allegedly used by a participant in the homicide of [named person] at [identified address] on November 15, 1991. [2] All records related to SPO's [named] investigation and testimony in the above case, including those pertaining to photos shown by him to [named person]. [3] All other records related to the above case, including those pertaining to any uncharged third party who could have participated in the homicide. Claiming to not yet have received responsive records, Attorney Baronoff petitioned this office and this appeal, SPR23/0271, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Department has provided a response. Accordingly, the Department is ordered to provide Attorney Baronoff with a response to her request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Attorney Baronoff may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
