General Counsel Massachusetts Clean Energy Center 294 Washington Street, Suite 1150 Boston, MA 02108 Dear Attorney Hitt: I have received the petition of Colman Herman appealing the response of the Clean Energy Center (Center) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 14, 2023, Mr. Herman requested, “… any and all agreements that the Massachusetts Clean Energy Center has with blade developers.” The Center responded on January 31, 2023. Unsatisfied with the response, Mr. Herman petitioned this office and this appeal, SPR23/0275, was opened as a result. Based upon a conversation between a Public Records Division senior attorney and a Center representative, it is my understanding that the Center intends on providing a further response to Mr. Herman to address his request for public records. Accordingly, the Center is ordered to provide Mr. Herman with said response in a manner consistent with the Public Records Law and its Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Herman may appeal the substantive nature of the Center’s response within ninety days. See 950 C.M.R. 32.08(1).
