The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records February 27, 2023 SPR22/0279 Helene Bettencourt Associate Commissioner Commissioner’s Office Department of Elementary and Secondary Education 75 Pleasant Street Malden, MA 02148 Dear Ms. Bettencourt: I have received the petition of Mr. Robert Moray appealing the nonresponse of the Department of Elementary and Secondary Education (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 28, 2023, Mr. Moray requested: [A]ll records related to advertisement placements on any medium (e.g., television, radio, internet, etc.) for the [Department]… that were initiated within the past 365 days. This includes, but is not limited to: where the advertisement was placed, the amount of money spent to place the advertisement, and the length of the advertising campaign. Claiming to not yet have received responsive records, Mr. Moray petitioned this office and this appeal, SPR23/0279, was opened as a result. Subsequently, in an email dated February 17, 2023, Mr. Moray states, “Ms. Helene Bettencourt… provided a response to my request. This response contained the records that I had requested, and I would deem it to be satisfactory.” Where the basis of this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed.
