The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records February 27, 2023 SPR22/0281 Helene Bettencourt Associate Commissioner Commissioner’s Office Department of Elementary and Secondary Education 75 Pleasant Street Malden, MA 02148 Dear Ms. Bettencourt: I have received the petition of Robert Moray appealing the nonresponse of the Department of Elementary and Secondary Education (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 29, 2023, Mr. Moray requested records related to the Commissioner’s calendar and daily work activities. Claiming to not yet have received responsive records, Mr. Moray petitioned this office and this appeal, SPR23/0281, was opened as a result. Subsequently, in an email dated February 23, 2023, Mr. Moray states, “I have received a response to the records request[.] I am in the process of working with the [Department]… to narrow the request, as I have been told that there are a large number of responsive records.” Where the basis of this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. I encourage Mr. Moray and the Department to communicate further in order to facilitate producing records efficiently and affordably. Mr. Moray may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
