Associate Legal Counsel Middlesex County Sheriff’s Office 400 Mystic Avenue, 4th Floor Medford, MA 02155 Dear Attorney Patel: I have received the petition of Dr. Caitlin Farrell appealing the response of the Middlesex County Sheriff’s Office (Office) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On October 13, 2022, Dr. Farrell requested, the following: 1. All documents reflecting current policies and protocols on Hepatitis C and HIV 2. Any documents relating to policies around Hepatitis C testing (i.e., testing protocols) 3. Any documents relating to policies around HIV testing 4. Any documents relating to Hepatitis C treatment (treatment protocols) 5. Any documents relating to HIV treatment 6. Any documents related to the number of Hepatitis C tests requested by inmates 7. Any documents related to the number of HIV tests requested by inmates 8. Any documents reflecting the total number of people testing for Hepatitis C in 2021 (by race and ethnicity, if possible) 9. Any documents reflecting the total number of people testing for HIV in 2021 (by race and ethnicity, if possible) 10. A copy of the medical intake form The Office responded on February 14, 2023. Unsatisfied with the response, Dr. Farrell petitioned this office and this appeal, SPR23/0317, was opened as a result. Subsequently, I learned that the Office responded to Dr. Farrell’s request with a further response sent on February 23, 2023. Where the basis of this appeal was opened as a result of the Office’s February 14, 2023 response, I will now consider this administrative appeal closed. Dr. Farrell may appeal the substantive nature of the Office’s response within ninety days. See 950 C.M.R. 32.08(1).
