Records Access Officer Executive Office of Public Safety and Security One Ashburton Place Boston, MA 02108 Dear Attorney Mullaney: I have received the petition of Mark Adams appealing the nonresponse of the Executive Office of Public Safety and Security (Office) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 6, 2022, Mr. Adams requested the following: [1] All documents, the notes referenced, emails, communications of any sort that discuss or have anything to do with the … interview [that] was memorialized through notes [including] … anything from employees of the Commonwealth to and from each other as well, as well as any committee members … [2] All documents, emails, notes etc. referenced … In addition to the interview notes additional documentation such as emails and letters [that] were also received [including] copies of the emails and letters and any documents of any kind it references at least 7 interviews, all of which should have emails, notes and documents. Previous Appeal This request was the subject of a previous appeal. See SPR22/2934 Determination of the Supervisor of Records (January 4, 2023). In my January 4th determination, I ordered the Office to provide a response to the request. Subsequently, the Office responded on February 17, 2023. Unsatisfied with the Office’s response, Mr. Adams further appealed, and this case was opened as a result. SPR23/0332 Page 2 March 6, 2023 Supplemental Response Based on an email from the Office to Mr. Adams and this office on March 6, 2023, I understand that the Office intends to provide a supplemental response to Mr. Adams. Specifically, the Office states that it “will be working with the State Police to conduct a search of State Police records [and] will conduct the search right away and get back to [Mr. Adams] with any responsive records.” Accordingly, said response must be provided in a manner consistent with the Public Records Law and its regulations within ten business days. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. If issues remain unresolved, Mr. Adams may appeal the substantive nature of the Office’s supplemental response within ninety days. See 950 C.M.R. 32.08(1).
