Assistant City Solicitor Law Department City of Worcester 455 Main Street, Room 301 Worcester, MA 01608 Dear Attorney Thompson: I have received the petition of Matt Magnarelli appealing the response of the City of Worcester (City) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On February 2, 2023, Mr. Magnarelli requested the following information: 1. The employment contract of Public Employee . . . and all exhibits, notes, and addendums. 2. The personnel file of Public Employee . . . in its entirety including all exhibits, notes, and addendums. 3. Any emails sent or received from Public Employee . . . regarding any “school committee meeting” or any mention of a school committee meeting after 1/1/23. 4. Any emails sent or received from Public Employee . . . including [specified search terms] after 1/1/23. 5. Any emails sent or received from Public Employee . . . regarding the news reporter or news agency as [specified names] or reporter. . . . This includes any reference to [specified individual] in any way, including his news business . . . or his first and last name in any way. The City responded on February 19, 2023. Unsatisfied with the response, Mr. Magnarelli petitioned this office and this appeal, SPR23/0343, was opened as a result. Based upon a conversation between a representative of the City and a staff attorney of the Public Records Division, it is my understanding that the City intends on providing a further response to Mr. Magnarelli to address the records request. SPR23/0343 Page 2 March 6, 2023 Accordingly, the City is ordered to provide Mr. Magnarelli with said response in a manner consistent with the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us.
