G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 16, 2023, Mr. Arriaga requested “... a complete unredacted copy of all documents related to an incident that happened in Springfield Mass on Main St. and the corner of Arch St. on [identified date] in which [a named person] was killed.” Claiming to not yet have received a response, Mr. Arriaga petitioned this office and this appeal, SPR23/0345, was opened as a result. Subsequently, I learned that the City intends on providing a written response to Mr. Arriaga. Accordingly, the City is ordered to provide Mr. Arriaga with a response in a manner consistent with the Public Records Law, its Regulations and this order within ten business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Arriaga may appeal the substantive nature of the City’s response within ninety days. See 950 C.M.R. 32.08(1).
