See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On February 2, 2023, Mr. Magnarelli requested the following records: [1] Any emails, notes or memos sent or received from any Teacher, Administrator, Faculty Member, or School Committee Member regarding [an identified news publication and individual][.] [2] Any emails, notes or memos sent or received from any Teacher, Administration or School Committee Member regarding any events, or discussions of the School Committee Meeting on 1/30/23. [3] All emails, all attachments, memos, and notes to and from any School Committee Member from the date starting on 1/29/23 through 2/2/23[.] Claiming to not yet have received responsive records, Mr. Magnarelli petitioned this office and this appeal, SPR23/0348, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the District has provided a response. Accordingly, the District is ordered to provide Mr. Magnarelli with a response to his request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Magnarelli may appeal the substantive nature of the District’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
