The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records March 13, 2023 SPR23/0381 Kate Silvia Director of Communications Department of Correction Legal Division 70 Franklin Street, Suite 600 Boston, MA 02110-1327 Dear Ms. Silvia: I have received the petition of Darius Gibson, appealing the response of the Department of Correction (Department) to a request for public records. G. L. c. 66, § l0A; see also 950 C.M.R. 32.08(1). On January 20, 2023, Mr. Gibson requested the following records: 1. All documentation in inmate management system showing the names of correctional officers who have researched me and what they have researched about me for the years 2022, 2023. 2. Copies of all complaints with names redacted made against ... [named] correctional officers. 3. Disciplinary history for ... [named] correctional officers. The Department responded on February 1, 2023. Unsatisfied with the Department’s response, Mr. Gibson petitioned this office and this appeal, SPR23/0381, was opened as a result. Based upon a conversation between a Public Records Division senior attorney and a Department representative, it is my understanding that the Department intends on providing a further response to Mr. Gibson. Accordingly, the Department is ordered to provide Mr. Gibson with said response in a manner consistent with the Public Records Law and its Regulations within 10 business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Gibson may appeal the substantive nature of the Department’s response within ninety days. See 950 C.M.R. 32.08(1).
