Deputy General Counsel Massachusetts Parole Board 12 Mercer Road Natick, MA 02324 Dear Attorney Doherty: I have received the petition of Kevin Norris appealing the nonresponse of the Massachusetts Parole Board (Board) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On February 3, 2023, Mr. Norris requested the following documents: [1] ... any document showing all the Revocation decisions within the last (2) years, that, resulted in “Alternatives to confinement” being considered and granted; [2] ... any document showing the Racial Breakdown of Provisional, and final revocation decisions for the Worcester region 4 office. Claiming to not yet have received a response, Mr. Norris petitioned this office and this appeal, SPR23/0389, was opened as a result. Subsequently, I learned that a representative from the Board intends on providing a written response to Mr. Norris. Accordingly, the Board is ordered to provide Mr. Norris with a response in accordance with the Public Records Law, its Regulations and this order within ten business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Norris may appeal the substantive nature of the Board’s response within ninety days. See 950 C.M.R. 32.08(1).
