G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 22, 2023, Mr. Herman requested, “…any all communications from and to [a named individual] related to bus issues”. On January 26, 2023, Mr. Herman modified his request to “bussing issues dealing with ‘difficulties in transporting students’.” The City responded on January 26, 2023 and February 23, 2023. Unsatisfied with the responses, Mr. Herman petitioned this office and this appeal, SPR23/0396, was opened as result. Subsequently, I learned that the City provided a further response on March 9, 2023. Where the basis of this appeal was opened as a result of the City’s January 26th and February 23rd responses, I will now consider this administrative appeal closed. Mr. Herman may appeal the substantive nature of the City’s March 9th response within ninety (90) days. See 950 C.M.R. 32.08(1).
