Associate General Counsel Massachusetts Gaming Commission 101 Federal Street, 12th Floor Boston, MA 02110 Dear Attorney Wang: I have received the petition of William Fernandes appealing the response of the Massachusetts Gaming Commission (Commission) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 31, 2023, Mr. Fernandes requested the following from 2021-2022: [1] . . . any and all records in your custody related to corroborated Fair Deal Criminal Complaints filed against Encore Hotel and Casino, Boston. [2] . . . any Mass State Police or Everett Police reports related to Encore Boston Harbor that were referred to your offices during the same timeframe. On January 31, 2023, the Commission responded. Unsatisfied with the Commission’s response, Mr. Fernandes petitioned this office, and this appeal, SPR23/0413, was opened as a result. Based upon a conversation between a Public Records Division staff attorney and a Commission representative, it is my understanding that the Commission intends on providing a subsequent response to Mr. Fernandes. Accordingly, the Commission is ordered to provide Mr. Fernandes with said response, in a manner consistent with the Public Records Law and its Regulations within 10 business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Fernandes may appeal the substantive nature of the Commission’s response within ninety days. See 950 C.M.R. 32.08(1).
