Counsel – Bureau of Water Resources Office of General Counsel Massachusetts Department of Environmental Protection 100 Cambridge Street, 9th Floor Boston, MA 02114 Dear Attorney Colton: On March 1, 2023, this office received your petition on behalf of the Department of Environmental Protection (Department) seeking an extension of time to produce records, and permission to charge for time spent segregating or redacting responsive records. G. L. c. 66, § 10(c); G. L. c. 66, § 10(d)(iv); see also 950 C.M.R. 32.06(4). As required by law, the Department furnished a copy of this petition to the requestor. G. L. c. 66, § 10(c); G. L. c. 66, § 10(d)(iv)(2). On February 14, 2023, Chris Fay requested “an electronic copy of all public comments received electronically by MA DEP that are related to the Title 5 & Watershed Permit regulations.” In a letter to this office on March 3, 2023, the Department asks “to rescind its March 1, 2023, petition.” In light of the Department’s March 3rd letter, I find it is unnecessary to opine on the Department’s Mach 1st petition for an extension of time to produce records and permission to charge for time spent segregating or redacting responsive records.
