See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On February 3, 2023, Ms. Ortiz requested the following: [1] Any extreme temperature policy that the Department implemented this week to combat dangerous polar vortex below zero temperatures and responsive to PD interactions with the general public…[;] [2] Any policies, memos or directives regarding arresting homeless individuals during 2022/2023 winter months by any City Departments…[.] Claiming to not yet have received responsive records, Ms. Ortiz petitioned this office and this appeal, SPR23/0427, was opened as a result. Subsequently, I learned that the Department provided a response to Ms. Ortiz on March 6, 2023. Where the basis of this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. It is my understanding that Ms. Ortiz has appealed the March 6, 2023 response resulting in a new appeal which is currently opened as SPR23/0471.
