Records Access Officer Office of the General Counsel Department of Transportation 10 Park Plaza Boston, MA 02116 Dear Attorney Doyle: I have received the petition of John York appealing the nonresponse of the Department of Transportation (MassDOT) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On February 7, 2023, Mr. York requested numerous information related to city sidewalks and bike paths including “legislative acts, executive orders, job descriptions, MassDOT directives and/or policies and/or other documents.” Claiming to not yet have received a response, Mr. York petitioned this office and this appeal, SPR23/0432, was opened as a result. Subsequently, I learned that MassDOT intends on providing a written response to Mr. York. Where the basis of this appeal was opened as a result of MassDOT’s lack of a written response, I will now consider this administrative appeal closed. Mr. York may appeal the substantive nature of MassDOT’s response within 90 days. See 950 C.M.R. 32.08(1).
