The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records March 17, 2023 SPR23/0453 Linda Koutoulas City Clerk City of Haverhill 4 Summer Street City Hall, Room 118 Haverhill, MA 01830 Dear Ms. Koutoulas: I have received the petition of Leah Marie Barrault, Esq. appealing the nonresponse of the City of Haverhill (City) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On February 3, 2023, Attorney Barrault requested the following records: 1. A copy of the final report, and all drafts, of the recently completed staffing study for the Haverhill Fire Department. 2. All memoranda, reviews, emails, and notes to or from any City employees relating to the staffing studying for the Haverhill Fire Department. 3. All documents relating to payment for the staffing study, including but not limited to, RFP, RFP responses, contracts for services, purchase orders, vendor invoices, and invoice payment records. 4. All documents and/or materials provided to or received from the vendor who prepared the study. 5. All notes, minutes, and agenda documents from any meetings, telephone calls, or video calls, with such vendor concerning the study. 6. All critiques, action plans, cover letters, or analysis related to the study created by or sent to any City employee. Claiming to not yet have received responsive records, Attorney Barrault petitioned this office and this appeal, SPR23/0453, was opened as a result. Subsequently, I learned that the City provided Attorney Barrault with a response dated March 13, 2023. Where the basis of this appeal was opened as a result of the City’s lack of a written response, I will now consider this administrative appeal closed.
