Records Access Officer Department of Conservation and Recreation 251 Causeway Street, 9th Floor Boston, MA 02114 Dear Attorney Tencellent: I have received the petition of John R. Woodsmall III appealing the response of the Department of Conservation and Recreation (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 22, 2022, Mr. Woodsmall requested various records between the City of Worcester and the Department related to the FY 2023 charges for the period from August 1, 2022 to the present. Prior Appeal This request was the subject of a previous appeal. See SPR22/0088 Determination of the Supervisor of Records (January 30, 2023). The Department responded on February 13, 2023. Unsatisfied with the response, Mr. Woodsmall petitioned this office and this appeal, SPR23/0455, was opened as a result. In an email dated March 16, 2023, I learned that the Department intends on providing a further response to Mr. Woodsmall. Accordingly, the Department is ordered to provide Mr. Woodsmall with said response in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Woodsmall may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
