Bourquin, Esq., of American Civil Liberties Union Foundation of Massachusetts, Inc., appealing the nonresponse of the Department of State Police (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On February 1, 2023, Attorney Bourquin requested the following records: [1] Records reflecting any interactions between MSP personnel and individuals soliciting financial contributions from motorists in Worcester or Millbury since April 1, 2022... [2] Records including communications containing, describing, or referring to any rules, policies, practices, or instructions conveyed by or to MSP personnel concerning whether, when or under what circumstances or conditions individuals can or cannot seek donations from motorists or others on Route 20 in Worcester or Millbury and/or near the intersections of Routes 146, Route 20 and the Mass Pike and/or on or near entrances, exits or ramps to or from the Mass Pike. [3] Records discussing, containing, describing, or referring to any law, regulation or policy prohibiting the seeking of donations on Route 20 in Worcester or Millbury and/or near the intersections of Routes 146, Route 20 and the Mass. Claiming to not yet have received responsive records, Attorney Bourquin petitioned this office and this appeal, SPR23/0456, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Department has provided a response. Accordingly, the Department is ordered to provide Attorney Bourquin with a response to the request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office.
