Assistant City Solicitor City of Brockton 45 School Street Brockton, MA 02301 Dear Attorney Donegan: I have received the petition of David Fox appealing the nonresponse of the City of Brockton (City) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On February 21, 2023, Mr. Fox requested, “... all executed towing contracts, verifications, applications, compliance verifications, due diligence complaints, etc. between the City and any of their subsidiaries, with [named] towing or any other entity that may go by that similar type name, and by [named] towing, or service, or similar name ...” Claiming to not yet have received a response, Mr. Fox petitioned this office and this appeal, SPR23/0460, was opened as a result. Subsequently, I learned that the City intends on providing a written response to Mr. Fox. Accordingly, the City is ordered to provide Mr. Fox with a response in accordance with the Public Records Law, its Regulations and this order within ten business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Fox may appeal the substantive nature of the City’s response within ninety days. See 950 C.M.R. 32.08(1).
