G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On February 21, 2022, Mr. Gerhardson requested, “[a]ll communications to or from Governor Maura Healey’s office possessed by the Secretary of the Commonwealth’s office between Jan. 6, 2023 and Feb. 21, 2023.” On February 22, 2023, Mr. Gerhardson modified his request as follows: Between the timeframe of Jan. 6, 2023 and Feb. 21, 2023, of the following [records] created William Galvin or any person working in their official capacity as a representative of his office transmitted to Maura Healey, or any person working in their official capacity as a representative of her office; and any of the following [records] created by Maura Healey, or any person working in their official capacity as a representative of her office and transmitted by any means to William Galvin or any person working in their official capacity as a representative of his office[.] The Division responded on March 8, 2023. Unsatisfied with the response, Mr. Gerhardson petitioned this office and SPR23/0466, was opened as a result. Subsequently, I learned that the Division provided a further response on March 16, 2023. Where this appeal was opened as a result of the Division’s March 8th response, I will now consider this administrative appeal closed. Mr. Gerhardson may appeal the substantive nature of the Division’s March 16th response within ninety (90) days. See 950 C.M.R. 32.08(1).
