Gaitan Director of Strategic Communications Massachusetts Military Division 2 Randolph Road Hanscom AFB, MA 01731 Dear Mr. Gaitan: I have received the petition of Patrick O’Toole appealing the nonresponse of the Massachusetts Military Division (Division) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On February 1, 2023, Mr. O’Toole requested all approved submittals and change orders concerning HVAC and plumbing insulation. Claiming to not yet have received a response, Mr. O’Toole petitioned this office and this appeal, SPR23/0477, was opened as a result. Subsequently, I learned that a representative from the Division intends on providing a written response to Mr. O’Toole. Accordingly, the Division is ordered to provide Mr. O’Toole with a response in accordance with the Public Records Law, its Regulations and this order within ten business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. O’Toole may appeal the substantive nature of the Division’s response within ninety days. See 950 C.M.R. 32.08(1).
