See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On February 2, 2023, Mr. Magnarelli requested the following records: [1] Any emails, notes or memos sent or received from any Teacher, Administrator, Faculty Member, or School Committee Member regarding [an identified news publication and individual][.] [2] Any emails, notes or memos sent or received from any Teacher, Administration or School Committee Member regarding any events, or discussions of the School Committee Meeting on 1/30/23. [3] All emails, all attachments, memos, and notes to and from any School Committee Member from the date starting on 1/29/23 through 2/2/23[.] Prior Appeal The requested records were the subject of a prior appeal. See SPR23/0348 Determination of the Supervisor of Records (March 6, 2023). In my March 6th determination, I ordered the District to provide a response to Mr. Magnarelli’s request. On March 9, 2023, the District responded and provided a fee-estimate. Objecting to the fees, Mr. Magnarelli petitioned this office and this appeal, SPR23/0478, was opened as a result. Subsequently, I learned that the District responded to Mr. Magnarelli’s request with a further response sent on March 15, 2023. Where the basis of this appeal was opened as a result of the District’s March 9th response, I will now consider this administrative appeal closed.
