Deputy General Counsel Massachusetts Parole Board 12 Mercer Road Natick, MA 02324 Dear Attorney Doherty: I have received the petition of Kevin Norris appealing the nonresponse of the Parole Board (Board) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On February 10, 2023, Mr. Norris requested the following: [1] Any document showing how much money the board collected-received under the American Rescue Plan Act, and from any other pandemic relief program; [2] Any document showing how much money the parole board spent and what exactly it spent the money received the American Rescue Plan [A]ct and/or pandemic relief funding on; and [3] Any and all records relating to the Region 4 parole office, e.g., payroll, and expenditures, and the names and races of all officers, and employees. Claiming to not yet have received responsive records, Mr. Norris petitioned this office and this appeal, SPR23/0494, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Board has provided a response. Accordingly, the Board is ordered to provide Mr. Norris with a response to the request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Norris may appeal the substantive nature of the Board’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
