G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On February 15, 2023, Mr. Mirino requested the following records regarding ambulance billing services: [1] A copy of the signed contract[.] [2] A copy of all vendors proposal(s), excluding confidential information. [3] A copy of any documents that show vendors scores and/or ranks during evaluations, including the pricing (percentage rate) submitted by all vendors[.] [4] A list of companies that submitted a proposal and a list of companies that requested the RFP. [5] Any reports over any time period related to contract performance... Claiming to not yet have received a response, Mr. Mirino petitioned this office and this appeal, SPR23/0495, was opened as a result. Subsequently, I learned that the Town intends on providing a written response to Mr. Mirino. Accordingly, the Town is ordered to provide Mr. Mirino with said response in accordance with the Public Records Law, its Regulations and this order within ten business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Mirino may appeal the substantive nature of the Town’s response within ninety days. See 950 C.M.R. 32.08(1).
