Assistant District Attorney Plymouth County District Attorney’s Office 166 Main Street Brockton, MA 02301 Dear Attorney Palumbo: I have received the petition of Thomas B. Farrey III, Esq., of Burns & Farrey, P.C., appealing the response of the Plymouth County District Attorney’s Office (Office) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 7, 2023, Attorney Farrey requested video records concerning an incident from a named Dollar Tree location. On March 7, 2023, the Office responded. Unsatisfied with the Office’s response, Attorney Farrey petitioned this Office and this appeal, SPR23/0511, was opened as a result. Based upon a conversation between a Public Records Division staff attorney and an Office representative, it is my understanding that the Office intends on providing a subsequent response to Attorney Farrey. Accordingly, the Office is ordered to provide Attorney Farrey with a response to his request in a manner consistent with the Public Records Law and its Regulations within 10 business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us.
