Hurtubuise City Clerk City of Medford 85 George P. Hassett Drive, Room 103 Medford, MA 02155 Dear Mr. Hurtubuise: I have received the petition of Steven J. Fonseca, Esq., on behalf of his client, Teamsters Local 25 (Local 25), appealing the response of the City of Medford (City) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 22, 2022, Local 25 requested “[u]nredacted copies of any and all documents, memoranda, reports, statements, notes, audio or video recordings, correspondence, invoices, or any other documentation related to the investigation and surveillance” of a specific individual. The City provided a response on January 9, 2023. Unsatisfied with the City’s response, Attorney Fonseca petitioned this office and SPR23/0522, was opened as a result. Based upon a conversation between a representative of the City and a staff attorney of the Public Records Division, it is my understanding that the City intends on providing a further response to Attorney Fonseca to address Attorney Fonseca’s concerns. Accordingly, the City is ordered to provide Attorney Fonseca with said response in a manner consistent with the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Attorney Fonseca may appeal the substantive nature of the City’s response within ninety days. See 950 C.M.R. 32.08(1).
