The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records March 31, 2023 SPR23/0539 Nancy Salvatore Town Clerk Town of Windsor 1890 Route 9 Windsor, MA 01270 Dear Ms. Salvatore: I have received the petition of Derek Rougeau appealing the nonresponse of the Town of Windsor (Town) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 3, 2023, Mr. Rougeau requested the following records: [1] ... all building permits issued to [named individuals] or agent of the aforementioned individuals for the period of 01/01/2015 to present. Include relevant dates and work to be done described in the permit ad final inspection date [2] ... all trenching permits issued to [named individuals] or agent of aforementioned individuals for the period of 01/01/2015 to present. Include descriptions of the work to be done[.] Claiming to not yet have received responsive records, Mr. Rougeau petitioned this office and this appeal, SPR23/0539, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Town has provided a response. Accordingly, the Town is ordered to provide Mr. Rougeau with a response to his request, provided in a manner consistent with this order, the Public Records Law, and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Rougeau may appeal the substantive nature of the Town’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
