The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records April 3, 2023 SPR23/0542 Timothy Benson Detective West Boylston Police Department 141 Sterling Street West Boylston, MA 01583 Dear Detective Benson: I have received the petition of John Rousseau appealing the response of the West Boylston Police Department (Department) to a request for public records. G. L. c. 66, § l0A; see also 950 C.M.R. 32.08(1). On February 27, 2023, Mr. Rousseau requested two police reports. On March 9, 2023, the Department responded. Unsatisfied with the Department’s response, Mr. Rousseau petitioned this office and this appeal, SPR23/0542, was opened as a result. Based upon a conversation between a Public Records Division staff attorney and a Department representative, it is my understanding that the Department intends on providing a subsequent response to Mr. Rousseau. Accordingly, the Department is ordered to provide said response in a manner consistent with the Public Records Law and its Regulations within ten business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. Rousseau may appeal the substantive nature of the Department’s response within ninety days. See 950 C.M.R. 32.08(1).
