The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records April 10, 2023 SPR23/0567 Helene Bettencourt Records Access Officer Office of the Commissioner Department of Elementary and Secondary Education 75 Pleasant Street Malden, MA 02148 Dear Ms. Bettencourt: I have received the petition of Robert Moray appealing the response of the Department of Elementary and Secondary Education (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 4, 2023, Mr. Moray requested “…updated records concerning all adjudicated cases of noncompliance.” Mr. Moray also requested “…an updated count on the current number of complaints PRS is actively adjudicating…” from a prior request. The Department provided a response on March 17, 2023. Unsatisfied with the Department’s response, Mr. Moray petitioned this office and SPR23/0567, was opened as a result. Based upon a conversation between a representative of the Department and a staff attorney of the Public Records Division, it is my understanding that the Department intends on providing a further response to Mr. Moray to address his records request. Accordingly, the Department is ordered to provide Mr. Moray with said response in a manner consistent with the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Moray may appeal the substantive nature of the Department’s response within ninety days. See 950 C.M.R. 32.08(1).
