Records Access Officer Office of the General Counsel Massachusetts Department of Transportation 10 Park Plaza Boston, MA 02116 Dear Attorney Doyle: I have received the petition of Nathan Gibson appealing the nonresponse of the Department of Transportation (MassDOT) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 3, 2023, Mr. Gibson requested, “...copies of public records that relate to the Road Safety Audit for Interstate 90 Exit 17 Interchange - Newton Corner including documents or reports relating to (i) Road Safety Audit; (ii) collection and analysis of existing conditions; and (iii) traffic data collection, field observations, signal inventory, safety reviews and existing conditions evaluation.” Claiming to not yet have received a response, Mr. Gibson petitioned this office and this appeal, SPR23/0573, was opened as a result. Subsequently, I learned that MassDOT intends on providing a written response to Mr. Gibson. Accordingly, MassDOT is ordered to provide Mr. Gibson with said response in accordance with the Public Records Law, its Regulations and this order within ten business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Gibson may appeal the substantive nature of MassDOT’s response within 90 days. See 950 C.M.R. 32.08(1).
