Director of Public Records City of Boston One City Hall Square; Room 721 Boston, MA 02201 Dear Attorney Williams: I have received the petition of Colman Herman appealing the response of the City of Boston Transportation Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 28, 2023, Mr. Herman requested copies of “any and all documents that provide information regarding the investigation of the Department’s parking enforcement officers, as reported at the following link . . .” Prior appeal The requested records were the subject of a prior appeal. See SPR23/0481 Determination of the Supervisor of Records (March 24, 2023). In the March 24th determination, the Department was ordered to provide Mr. Herman with a response to his request. On March 30, 2023, after not receiving any requested records from the Department, Mr. Herman petitioned this office and this appeal, SPR23/0602, was opened as a result. Subsequently, in a March 31, 2023 email from Attorney Williams to Mr. Herman, the Department indicates that it intends to provide Mr. Herman with a further response to the January 28th request. Conclusion Accordingly, the Department is ordered to provide Mr. Herman with said response in a manner consistent with this order, the Public Records Law, and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. Herman may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
