Zerola, Esq. appealing the nonresponse of the Town of Lynnfield (Town) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 5, 2023, Attorney Zerola requested the following records: [1] The entire file for Davio’s Northern Italian Steakhouse located at 1250 Market Street, Lynnfield, MA including but not limited to liquor licenses, business’ licenses, current insurance policies including liquor liability and general liability and specifically the insurance policies in effect on February 18, 2023; any violations and complaints. [2] Street video/traffic camera video from Lynnfield Market Place to Walnut Street to the Saugus border on 02/18/2023 from 6:00 p.m. through 6:25 p.m. Claiming to not yet have received responsive records, Attorney Zerola petitioned this office and this appeal, SPR23/0604, was opened as a result. Subsequently, I learned that the Town provided Attorney Zerola with a response dated April 5, 2023. Where the basis of this appeal was opened as a result of the Town’s lack of a written response, I will now consider this administrative appeal closed. Attorney Zerola may appeal the substantive nature of the Town’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
