G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On October 31, 2023, Mr. DeFraia requested, “20 incident reports, all related to U-Visa applications that your department received, from July 1, 2021, to December 31, 2021, according to EOPSS[.]” The Department provided responses on March 26 and March 31, 2023. Unsatisfied with the responses, Mr. DeFraia petitioned this office and this appeal, SPR23/0638, was opened as a result. Subsequently, I learned that the Department provided a further response on April 4, 2023. Where this appeal was opened as a result of the Department’s March 26th and March 31st responses, I will now consider this administrative appeal closed. Mr. DeFraia may appeal the substantive nature of the Department’s April 4th response within ninety (90) days. See 950 C.M.R. 32.08(1).
