The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records April 18, 2023 SPR23/0639 Michael Nelson Superintendent Old Rochester Regional School District 135 Marion Road Mattapoisett, MA 02739 Dear Superintendent Nelson: I have received the petition of Kathleen LeClair, appealing the response of the Old Rochester Regional School District (District) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On February 26, 2023, Ms. LeClair requested the following: 1. Copies of all grant applications initiated applied for through actions of the Equity Subcommittee including but not limited to Hate Crime Grant, Building Equitable Grant, Project 351 Grant and any and all grants submitted and awarded for based on recommendations from Equity sub-committee 2. Full accounting of how all grant monies were approved and expended 3. List of functions and duties of the Equity subcommittee per policy BDE 4. Accounting of cost of all surveys conducted at the recommendation of the Equity Subcommittee 5. Any and all contracts and payments engaging speakers, trainings, tech platforms as noted in Equity Subcommittee presentations, including but not limited to [11 named persons.] Prior Appeal The requested records were the subject of a prior appeal. See SPR23/0552 Determination of the Supervisor of Records (April 3, 2023). In my April 3rd determination, I closed the appeal after the District provided a further response on March 29, 2023. Unsatisfied with the District’s response, Ms. LeClair petitioned this office and this appeal, SPR23/0639, was opened as a result. Based upon a conversation between a Public Records Division staff attorney and a District representative, it is my understanding that the District intends on providing a subsequent response to Ms. LeClair. The District’s response will address the redactions made to the records that are responsive to part 5 of the request. Accordingly, the District is ordered to provide Ms. LeClair with said response in a manner consistent with this order, the Public Records Law, and its Regulations within 10 business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us.
