See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). In separate requests, Mr. Norris requested sought certain documents from the Board. On March 10, 2023, Mr. Norris requested the following records: [1] A copy of any and all documents showing the racial breakdown for final revocations for the Worcester region 4 office from January 1, 2019 to January 1, 2021[;] [2] A copy of any document showing the racial breakdown for parolees in Worcester region 4, e.g., how many parolees were under supervision from January 1, 2019 until the present day…[;] [3] A copy of any document showing the racial breakdown for final revocations for the whole parole board (all regional offices) from January 1, 2019 until the present day…[;] [4] A copy of any document showing the racial breakdown for parolees under supervision by the parole board…[.] On March 15, 2023, Mr. Norris requested the following records: [1] A copy of the report/findings of the Department of Justice concerning the Americans with Disabilities act[;] [2] A copy of civil action complaint filed against the parole board by the “DOJ” and/or any other federal agency[;] [3] A copy of any settlement agreement entered into by the parole board with the “DOJ” and/or any other federal agency[.] One Ashburton Place, Room 1719, Boston, Massachusetts 02108 • (617) 727-2832• Fax: (617) 727-5914 sec.state.ma.us/pre • pre@sec.state.ma.us Stacy Book SPR23/0641; SPR23/0642 Page 2 April 14, 2023 Claiming to not yet have received responsive records, Mr. Norris petitioned this office and these appeals, SPR23/0641 and SPR23/0642, were opened as a result. Despite being notified of the opening of these appeals, it remains unclear whether the Board has provided a response. Accordingly, the Board is ordered to provide Mr. Norris with a response to his requests, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us.
