The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records April 19, 2023 SPR23/0658 Tim Piwowar Superintendent Billerica Public Schools 365 Boston Road Billerica, MA 01821 Dear Superintendent Piwowar: I have received the petition of Debbie Barnes appealing the nonresponse of the Billerica Public Schools (School) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 20, 2023, Ms. Barnes requested “[a]ny and all documentation, emails, text messages, correspondence, meeting summaries, etc. related to the incident that happened in the BMHS parking lot on February 2, 2022.” Claiming to not yet have received responsive records, Ms. Barnes petitioned this office and this appeal, SPR23/0658, was opened as a result. Subsequently, I learned that the School provided Ms. Barnes with a response dated April 13, 2023. Where this appeal was opened as a result of the School’s lack of a written response, I will consider this administrative appeal closed. Ms. Barnes may appeal the substantive nature of the School’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
