See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 13, 2023, Ms. Aurilio requested, “…the amount of funds spent on lawyer fees for general education or special education circumstances for school years 2021-2022 and also 2022-2023. Please include any and all supporting documents for general and special education.” On March 27, 2023, the School responded, and provided responsive records in redacted form. Unsatisfied with the School’s response, Ms. Aurilio petitioned this Office and this appeal, SPR23/0674, was opened as a result. Based upon a conversation between a Public Records Division staff attorney and a School representative, it is my understanding that the School intends on providing a subsequent response to Ms. Aurilio. The School’s response will address an attorney client-privilege claim that the School did not claim initially. Accordingly, the School is ordered to provide Ms. Aurilio with said response in a manner consistent with this order, the Public Records Law, and its Regulations within 10 business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Ms. Aurilio may appeal the substantive nature of the School’s response within ninety days. See 950 C.M.R. 32.08(1).
