G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On October 31, 2023, Mr. DeFraia requested, “20 incident reports, all related to U-Visa applications that your department received, from July 1, 2021, to December 31, 2021, according to EOPSS[.]” Prior Appeal This request was the subject of a previous appeal. See SPR23/0638 Determination of the Supervisor of Records (April 5, 2023). In that determination, it was my understanding that the Department provided a subsequent response. The Department provided responses on April 3, 2023 and April 4, 2023. Unsatisfied with the responses, Mr. DeFraia petitioned this office and this appeal, SPR23/0694, was opened as a result. Subsequently, I learned that the Department provided a further response on April 20, 2023. Where the basis of this appeal was opened as a result of the Department’s April 3rd and April 4th responses, I will now consider this administrative appeal closed. Mr. DeFraia may appeal the substantive nature of the Department’s April 20th response within ninety (90) days. See 950 C.M.R. 32.08(1).
