See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 13, 2023, Mr. Sullivan requested “all emails regarding notification of ‘Honor Thy Teacher’ annual campaign to Billerica school community for the last 5 years.” On March 27, 2023, the School provided a fee estimate response. Later on March 27, 2023, Mr. Sullivan modified his request and requested “the generic email sent out once yearly by the [nonprofit] to the school community for the blackboard email accounts which in [non-email] specific. Please provide the once yearly email to me regarding the school wide notification of ‘Honor Thy Teacher’ annual campaign to Billerica school community for the last 5 years.” Claiming to not yet have received responsive records, Mr. Sullivan petitioned this office and this appeal, SPR23/0695, was opened as a result. Subsequently, I learned that the School provided a further response dated April 13, 2023 to Mr. Sullivan. Where this appeal was opened as a result of the School’s lack of a written response to Mr. Sullivan’s March 27th modified request, I will consider this administrative appeal closed. Mr. Sullivan may appeal the substantive nature of the School’s April 13th response within ninety (90) days. See 950 C.M.R. 32.08(1).
