Fogelman, Esq. appealing the nonresponse of the Massachusetts Convention Center Authority (Authority) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 16, 2023, Attorney Fogelman requested the following records: 1. The gross annual amount of money paid to any outside law firm, or sent to any outside law firm for payment to another third party, which money was for services related to, concerning or to address any: a. employee or employment matters; b. employment based claims or possible such claims by employees of the MCCA; c. settlement and/or non-disclosure agreements for the settlements of claims or possible claims by employees of the MCCA. for the past 5 years, broken down by year from 2018-2022 [including] money paid for this category of expenses through March 15, 2023. 2. The gross annual amount of money spent on non-law firm third party consultants which money was for services related to, concerning or to address any: a. employee or employment matters; b. employment based claims or possible such claims by employees of the MCCA; c. settlement and/or non-disclosure agreements for the settlements of claims or possible claims by employees of the MCCA. 3. The gross annual amount of money paid to any forensic information technology vendor, and/or to any private investigator to investigate and find out information relating to allegations or claims by employees of racial discrimination, broken down by year from 2018-2022. Please also include money paid for this category of expenses through March 15, 2023. 5. In the past 5 years, broken down by year, please identify the General Counsel of the MCCA, and the dates of such person’s employment as General Counsel. 6. For the period of 2018 to March 15, 2023, list any and all reimbursements to the General Counsel that exceeded $500. Claiming to not yet have received a response, Attorney Fogelman petitioned this office and this appeal, SPR23/0701, was opened as a result. Subsequently, I learned that the Authority provided a response to Attorney Fogelman on April 11, 2023. Where this appeal was opened as a result of the Authority’s lack of a written response, I will now consider this administrative appeal closed.
