Assistant General Counsel Department of Fish and Game 251 Causeway Street, Suite 400 Boston, MA 02114 Dear Attorney LaBate: On April 11, 2023, this office received your petition on behalf of the Department of Fish and Game (Department) seeking permission to charge for time spent segregating or redacting responsive records. G. L. c. 66, § 10(d)(iv). As required by law, it is my understanding that the Department furnished a copy of this petition to the requestor. G. L. c. 66, § 10(d)(iv). On March 28, 2023, Meg Sheehan requested: [1] File 21-20003, 395 Federal Furnace Road[;] [2] Records pertaining to [a named individual] and 403 Federal Furnace Road[;] [3] Records pertaining to Big West Pond, Little West Pond, and Grassy West Pond, Plymouth[.] Concurrent with this petition, the Department provided Ms. Sheehan with a fee estimate on April 11, 2023. In an email to this office on April 12, 2023, the Department stated, “[w]e have an update to the petition: the requester has agreed to pay the fee for review.” In light of the above, it is unnecessary to opine on the Department’s petition for permission to charge for time spent segregating or redacting responsive records.
