The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records April 27, 2023 SPR23/0744 Cathy Cummins Executive Director Assabet Valley Collaborative Central Administrative Offices 28 Lord Road, Suite 125 Marlborough, MA 01752 Dear Executive Director Cummins: I have received the petition of Robert Helminen appealing the nonresponse of the Assabet Valley Collaborative (Collaborative) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On February 7, 2023, Mr. Helminen requested “[a]ny and all correspondences, documents, notes & records pertaining to the construction project known as Reach Evolve Tenant Modification...” Claiming to not yet have received responsive records, Mr. Helminen petitioned this office and this appeal, SPR23/0744, was opened as a result. Previous Determination This request is the subject of a previous petition. See SPR23/0365 Determination of the Supervisor of Records (March 1, 2023). In my March 1st determination, I granted the Collaborative an extension of twenty (20) business days to provide a response. Despite being notified of the opening of this appeal, it remains unclear whether the Collaborative has provided a response. Accordingly, the Collaborative is ordered to provide Mr. Helminen with a response consistent with this order, the Public Records Law, and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Helminen may appeal the substantive nature of the Collaborative’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
