General Counsel Newton Public Schools 100 Walnut Street Newtonville, MA 02460 Dear Attorney Grady: I have received the petition of Attorney Maryanne Stanganelli, of Insider Inc., appealing the response of the Newton Public Schools (School) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On August 30, 2022, Matt Drange, of Insider Inc., requested “separation agreements and settlements” along with “records relating to any and all claims of misconduct against current and former teachers,” providing a date range and further description and clarification of the requested records. Previous Appeal This request was the subject of a previous appeal. See SPR23/0028 Determination of the Supervisor of Records (January 20, 2023). In my January 20th determination, I closed SPR23/0028 in light of the School providing a response to Attorney Stanganelli. Unsatisfied with the School’s January 20th response, Attorney Stanganelli further appealed, and this case was opened as a result. Subsequent to the opening of this appeal, based on telephone conversations between this office and an attorney for the School on April 26 and April 28, 2023, I understand that the School intends to provide Attorney Stanganelli with a supplemental response. Accordingly, said response must be provided in a manner consistent with the Public Records Law and its regulations within ten business days. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. If issues remain unresolved, Attorney Stanganelli may appeal the substantive nature of the School’s supplemental response within ninety days. See 950 C.M.R. 32.08(1).
