Ryan III, of the Amalgamated Transit Union, Local 1548, appealing the nonresponse of the Martha’s Vineyard Transit Authority (Authority) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 22, 2023, Mr. Ryan requested the following records: [1] Records showing each and every company and/or individual contracted to perform any transportation services for the Authority and all monies paid to these companies year to date. [2] A copy of each current contract with each such company and/or individual… [3] Records documenting the Authority Board’s deliberation and decision to authorize each such contract with each such company and/or individual, such as Board meeting minutes and Board resolutions. [4] Records showing each and every subcontractor of any such contractors. [5] A copy of each current contract between the contractor and subcontractor, to the extent it is in the Authority’s possession. Claiming to not yet have received responsive records, Mr. Ryan petitioned this office and this appeal, SPR23/0755, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Authority has provided a response. Accordingly, the Authority is ordered to provide Mr. Ryan with a response to his request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Ryan may appeal the substantive nature of the Authority’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
