Legal Counsel Department of Housing & Community Development 100 Cambridge Street, Suite 300 Boston, MA 02114 Dear Attorney Walleigh: On April 20, 2023, this office received your petition on behalf of the Department of Housing & Community Development (Department) requesting permission to charge for time spent segregating or redacting responsive records. G. L. c. 66, § 10(d)(iv). As required by law, it is my understanding that the Department furnished a copy of this petition to the requestor. G. L. c. 66, § 10(d)(iv). On April 7, 2023, Sarah Betancourt, of WGBH, requested: [1] …Anything that is similar to or comprising of a performance evaluation for [identified locations] between the dates of 2/21/21, and 4/7/23[;] [2] Correspondence [to] [identified locations] between the dates of 2/21/21, and 4/7/23[;] [3] If that does not limit the request enough, please limit the request to correspondence [to] [identified locations] between the dates of 2/21/21, and 4/7/23 from [identified individuals…] In an email to this office dated April 20, 2023, the Department stated that “Ms. Betancourt is withdrawing her public records request, so a fee will not be necessary.” Conclusion In light of the above, it is unnecessary to opine on the Department’s petition seeking permission to charge for time spent segregating or redacting responsive records.
