Assistant District Attorney Essex County District Attorney’s Office 10 Federal Street Salem, MA 01970 Dear Attorney Jiang: I have received the petition of Maggie Mulvihill appealing the response of the Essex County District Attorney’s Office (Office) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 11, 2023, Ms. Mulvihill requested: Pursuant to Brady v. Maryland (1963), all records related to law enforcement officers or personnel in which issues with their credibility has been raised, including but not limited to so-called “Brady lists,” also known as “LEAD (Law Enforcement Automatic Discovery) lists” or “Do Not Call” lists. We seek this information from Jan. 1, 2017 to present. On January 24, 2023, the Office responded. Unsatisfied with the Office’s response, Ms. Mulvihill petitioned this office and this appeal, SPR23/0775, was opened as a result. Subsequently, I learned that the Office provided a further response dated April 21, 2023 to Ms. Mulvihill. Where this appeal was opened as a result of the Office’s January 24th response, I will now consider this administrative appeal closed. Ms. Mulvihill may appeal the substantive nature of the Office’s April 21st response within ninety (90) days. See 950 C.M.R. 32.08(1).
