Kasten, Esq. of Looney Cohen & Aisenberg LLP, appealing the response of the Town of Needham Police Department (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On February 22, 2023, Attorney Kasten requested various records regarding the arrest and booking of a named person that occurred on November 22, 2019 at a Needham Police station. On March 8, 2023, the Department responded and indicated that they would provide a further response in 15 business days. On March 29, 2023, the Department responded and provided responsive records with redactions pursuant to Exemptions (a) and (c) of the Public Records Law. The Department also withheld records pursuant to Exemptions (a) and (c). Unsatisfied with the Department’s response, Attorney Kasten petitioned this office and this appeal, SPR23/0779, was opened as a result. In a communication dated April 25, 2023, the Department provided a further response to Attorney Kasten. In an email dated May 3, 2023, Attorney Kasten informed this office he wishes to withdraw the administrative appeal.
