The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records May 5, 2023 SPR23/0782 Barbara L. LaBombard City Clerk Records Access Officer 50 Payson Avenue Easthampton, MA 01027 Dear Ms. LaBombard: I have received the petition of Shelby Lee appealing the response of the City of Easthampton (City) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On April 11, 2023, Shelby Lee requested “any and all communications related to the school committee including but not limited to texts and emails from April 3rd 2023 to April 11, 2023,” and on April 13, 2023, narrowed the request “to communications from elected officials, including the mayor, city council and school committee.” The City responded on April 18, 2023, providing a link to numerous responsive records, and indicating it intended to provided additional records “shortly.” Unsatisfied with the City’s response, Shelby Lee appealed, and this case was opened as a result. Subsequent to the opening of this appeal, I learned that the City provided a supplemental response by email to Shelby Lee and this office on April 25, 2023, including a link to additional responsive records. As this appeal was opened based on the City’s April 18th response, I will now consider this administrative appeal closed. If unresolved issues remain, Shelby Lee may further appeal the substantive nature of the City’s April 25th response within ninety (90) days. See 950 C.M.R. 32.08(1). Sincerely, Manza Arthur Supervisor of Records cc: Shelby Lee One Ashburton Place, Room 1719, Boston, Massachusetts 02108 • (617) 727-2832 • Fax: (617) 727-5914 sec.state.ma.us/pre • pre@sec.state.ma.us
