The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records May 5, 2023 SPR23/0785 Kathleen Jackson City Clerk City of Attleboro 77 Park Street Attleboro, MA 02703 Dear Ms. Jackson: I have received the petition of Andrew Kerr appealing the response of the City of Attleboro (City) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 20, 2023, Mr. Kerr requested “an emailed copy of all text messages and email messages sent by any and all City Employees on City Funded Phones/Computers or Any Communications made on any Private Phone/Computer by any City Employee made on City Time and or While they were being paid and actively working for the city Between January 15th of 2022 through June 15th of 2022.” Previous Appeal This request was the subject of a previous appeal. See SPR22/0704 Determination of the Supervisor of Records (April 11, 2023). In my April 11th determination, I closed the appeal when I learned the City had provided Mr. Kerr with a response dated April 11, 2023. Unsatisfied with the City’s response, Mr. Kerr petitioned this office and this appeal, SPR23/0785, was opened as a result. Subsequently, I learned that the City provided a further response dated May 3, 2023 to Mr. Kerr. Where this appeal was opened as a result of the City’s April 11th response, I will now consider this administrative appeal closed. Mr. Kerr may appeal the substantive nature of the City’s May 3rd response within ninety (90) days. See 950 C.M.R. 32.08(1).
